of Licensing Policy until 25 November 2020 to allow for full and
effective consultation with the statutory consultees.
Effective consultation during full Covid-19
lockdown could not have been achieved which could be found to be
unlawful; seeking to adopt a statutory policy based on ineffective
consultation generates a significant risk of judicial review.
LGA guidance covering the review of licensing policies set out at https://www.local.gov.uk/approaches-managing-licensing-and-related-issues-during-covid-19-pandemic states the following.
Councils may want to consider with members whether it would be pragmatic to delay their consultation given the current challenges in effectively engaging with the local trade and residents. The LGA has flagged to the Home Office that this should be acceptable, assuming work is progressed once some level of normality has returned.
