Reasons: The reasons for the Sub-Committee reaching this
decision are as follows:
has read and heard all of the information before them.
is aware of and has taken into account any implications that may
arise from the Human Rights Act 1998.
The Sub-Committee in
reaching its decision has had due regard for its public sector
equality duty under section 149 of the Equality Act 2010 and
consider that in reaching their decision to grant the variation to
the premises licence they have fulfilled their duty under the
Equality Act 2010.
In reaching their
decision the Sub-Committee heard from Mrs White (the
Council’s Licensing & Land Charges Manager), Mr
Kheng (on behalf of the applicant), Mr
Davis (Environmental Health Officer - EHO), Miss Loveley and Mr Robbie and Mr Rush on behalf of Miss
Prior to today’s
hearing all parties were given the opportunity to consider the
noise assessment prepared by Peak Acoustics, and submitted on
behalf of the applicant. Further
information was also submitted by the applicant proposing amended
hours from that originally applied for in light of the conclusions
of the noise assessment.
During the hearing,
the Sub-Committee heard from Mr Kheng
how needed the beer garden is to the premises given how narrow
Church Street is and that Church Street is subject to a Public
Space Protection Order. The beer garden
is required for smokers, and so needs to be allowed to be in use
whenever the premises is open. The
applicant is confident that their proposed conditions would
effectively address use of the beer garden during the
